Terms of Service: Midwest Shooting Center

This document outlines the terms and conditions governing your use of the SMS messaging and phone call services provided by Midwest Shooting Center ("we," "us," or "our").

By opting in (from our website contact form, in-store sign-up, or any other opt-in method we provide), you ("you" or "user") agree to receive SMS messages and/or phone calls from us, and therefore you agree to be bound by these terms.


1 Consent for SMS Communication

  • Opt-In Procedure: By providing your mobile phone number and checking the explicit opt-in checkbox on our website (https://midwestshootingcenter.com) or any associated landing pages, you expressly consent to receive SMS messages from Midwest Shooting Center.

  • Two-Step Opt-In: A two-step opt-in process is performed through a process that requires both the phone number input AND a separate, unchecked checkbox tick, ensuring a double action for consent. No checkbox will be pre-selected.

  • Types of Messages: This consent encompasses various types of messages, including but not limited to: transactional, verification, informational, confirmation, appointment reminder, marketing, customer support, and operational messages. Each type is specifically defined in Section 3 below.

  • Non-Condition of Purchase: This consent is not a condition of purchasing any goods or services from Midwest Shooting Center. You have the right to opt out at any time.

  • Consent Logging: We maintain a detailed log of your consent, including the date and time of the opt-in, the originating IP address, and the specific opt-in channel. This ensures that all records are accurate and auditable for compliance requirements.

2 Consent for Phone Calls

  • Express Consent for Calls: By providing your phone number through our opt-in process, you also expressly consent to receive phone calls from Midwest Shooting Center, including calls made using an automatic telephone dialing system or prerecorded/artificial voice, for the purposes described herein.

  • Types of Calls: You may receive calls related to: appointment reminders, booking confirmations, customer support follow-ups, service updates, membership information, training class scheduling, and promotional offers.

  • Non-Condition of Purchase: Consent to receive phone calls is not a condition of purchasing any goods or services.

  • Revocation: You may revoke your consent to receive phone calls at any time by contacting us using the methods described in Section 5 or Section 10.

3 Types of SMS Messages

You may receive the following types of SMS messages from us:

  • Transactional Messages: Triggered by your actions or interactions with our services and directly related to your account or an active booking — including booking confirmations, range reservations, membership renewals, payment reminders, receipts, and other critical updates.

  • Verification Messages: Messages sent to verify your phone number or account for security purposes during initial registration, login attempts, or when additional security is needed.

  • Informational Messages: Important updates, policy changes, service announcements, range maintenance notices, hours of operation changes, or any other information that may affect your experience with our services.

  • Confirmation Messages: Sent to confirm specific actions you take, such as range booking, class registration, membership sign-up, account updates, and similar actions.

  • Reminder Messages: Sent to remind you of scheduled range appointments, training classes, membership renewal deadlines, upcoming events, or any pending activities.

  • Marketing Messages: Messages promoting special offers, discounts, new products or services, upcoming events (e.g., shooting competitions, new class offerings), and other promotional content from Midwest Shooting Center.

  • Customer Support Messages: Sent in response to customer service inquiries you make, as well as additional information required to resolve your inquiry or support issue.

  • Operational Messages: Messages related to the day-to-day operation of our services, such as password reset requests, account notifications, and other system-generated messages.

  • Feedback Requests: Messages requesting you to leave feedback or reviews about our services and facilities.

4 Message Frequency and Delivery

  • Varied Frequency: Message frequency varies depending on your engagement with our services. Transactional, verification, informational, confirmation, and reminder messages will be sent as needed. Marketing messages will be sent periodically, but we are committed to not sending excessive volumes.

  • Message Delivery: While we strive to deliver all messages, we are not responsible for message delivery failures due to network issues, carrier errors, or incorrect phone numbers. We utilize reliable delivery mechanisms; however, we cannot guarantee delivery in every situation.

  • Carrier Liability: Carriers (including but not limited to T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages.

5 Opt-Out and Help Procedures

  • Opt-Out Keywords: You can revoke your consent to receive SMS messages from Midwest Shooting Center at any time by replying with one of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any SMS message you receive from us.

  • Opt-Out Confirmation: Upon sending an opt-out keyword, you will receive a single confirmation message confirming that you have been unsubscribed.

  • Get Help: If you need assistance, reply HELP to any message you receive from us, or contact us at [email protected].

  • Alternative Opt-Out: You may also opt out by contacting our customer service team directly at [email protected] with a direct request to have your number removed from our SMS messaging list.

  • Timeframe for Removal: Upon receiving an opt-out request via keyword, we will promptly remove your mobile number from our marketing messaging list within 24 hours. Opt-out requests made by email may take up to 72 hours to process.

  • Rejoining: If you have opted out and wish to rejoin our SMS messaging program, you may do so by completing the opt-in process again on our website or by texting START or SUBSCRIBE to the number from which you previously received messages.

  • Transactional Messaging After Opt-Out: After opting out of marketing messages, you may still receive essential transactional, verification, informational, operational, and confirmation messages related to your current service. You must contact our support team directly to remove yourself from these types of messages if you no longer require them, or by canceling your services with us.

6 Message and Data Costs

  • Carrier Charges: Message and data rates may apply from your mobile carrier.

  • User Responsibility: You are solely responsible for any charges imposed by your mobile carrier.

  • No Midwest Shooting Center Fees: Midwest Shooting Center does not charge additional fees for sending or receiving SMS messages.

7 Privacy Practices Summary

  • We do NOT share, sell, rent, or trade your personal information with third parties for marketing purposes or any other purposes (unless ordered by a court for legal purposes or as otherwise described in our Privacy Policy).

  • Your privacy is of utmost importance to us. We collect and use your mobile phone number and related information in accordance with our full Privacy Policy, available on our website.

  • Mobile Information: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, except those required to facilitate message delivery (aggregators and providers of the text messaging services).

8 Message Content and Compliance

  • Compliance Standards: All SMS messaging and phone call activities by Midwest Shooting Center adhere to the Telephone Consumer Protection Act (TCPA), CTIA guidelines, CAN-SPAM Act, and all applicable state and federal regulations, including A2P 10DLC registration requirements.

  • Content Restrictions: We do not send any inappropriate, harmful, or illegal content, nor do we include content that would be considered offensive. All message content is brand-appropriate and complies with advertising standards and CTIA content guidelines.

  • Brand Representation: Messages will clearly identify the sender as Midwest Shooting Center and will use appropriate and standard branding where applicable.

9 Changes to These Terms

We reserve the right to change these Terms of Service at any time. We will post any updates on our website, and we will notify you of major updates. Your continued use of our SMS messaging and/or phone call services following any changes constitutes your acceptance of those changes.

SMS/Text Messaging and Phone Call Privacy

As an A2P 10DLC registered service provider, we adhere to the following principles:

  • Privacy policies and terms and conditions are displayed next to or in close proximity to the phone number entry fields on our website and opt-in forms.

  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

  • Text messaging originator opt-in data and consent will not be shared with any third parties, except those required to facilitate message delivery (aggregators and providers of the text messaging services).

  • End-user information is protected and not shared or sold to third parties for marketing, lead generation, or analytics purposes.

  • The opt-in and opt-out procedures for 10DLC traffic are clearly outlined in both the call-to-action (CTA) and the Terms of Service. Opt-in and opt-out occur via the 10DLC number, and short code opt-out routes are not used.

  • We collect your mobile phone number solely for the purpose of sending you the message types you consented to, as described in our Terms of Service.

  • We do not use your phone number or SMS opt-in data for any purpose other than providing the services you requested.

Opting Out

Sharing Information with Third Parties

Midwest Shooting Center does not sell, rent, or lease its customer lists to third parties.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Midwest Shooting Center may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Midwest Shooting Center, and they are required to maintain the confidentiality of your information.
